Drone operation in the US is governed by a strict set of rules. DJI stated in a recent press release that the FAA's new rules will allow drones to be put to work in construction, surveying, agriculture, firefighting, search and rescue, conservation, academic research, film and video production and countless other fields that will benefit from an affordable aerial perspective, DJI said in a Friday press release.

According to FAA rules, Commercial Drone operators are usually not allowed to fly:

  • Within 150 feet of any person, vessel, vehicle or structure which is not under the control of the pilot.
  • The maximum allowable altitude is 400 feet above the ground, and higher if your drone remains within 400 feet of a structure.
  • The maximum speed is 100 mph. 
  •  You can fly during daylight or in twilight (30 minutes before official sunrise to 30 minutes after official sunset, local time) with appropriate anti-collision lighting.
  • Must weigh less than 55 pounds 
  • UAS operations are prohibited within a radius of three nautical miles of the stadium or venue.
  • Within five miles of an airport.
  • Within a 3 nautical mile radius of any stadium with a seating capacity of 30,000 or more people during a Major Sports Event. One hour before the scheduled event time until one hour after the event concludes.
  • The UA must be operated within visual line of sight (VLOS) of the PIC at all times. 
  • The Visual observer (VO) and Pilot in command (PIC) must be able to communicate verbally at all times; electronic messaging or texting is not permitted during flight operations.
  • Drone operators must also qualify for flying certificates and be at least 16 years old. 
  • You can request a waiver of most operational restrictions if you can show that your proposed operation can be conducted safely under a waiver.
  • Operators need to apply for waivers if they seek to fly drones at night, above 400 feet and in other specific types of operations, the FAA noted.
  • All drone pilots, both professional and amateur, must abide by these rules. Failure to do so can lead to a criminal prosecution.
